Judgment for Business Owner Via MSJ by Sacramento Office

In a wrongful death suit arising out of a fatal shooting at a rooftop music event against a restaurant proprietor and its owner, as well as other entities, Peter Dye and Mark Cayaba filed an MSJ to dismiss the various tort-based causes of action against their clients.  The MSJ asserted that the restaurant and its owner had no duty to protect patrons from unforeseeable criminal conduct and their clients did not breach any duty they may have by hiring security for the event.  The trial court requested supplemental briefing on the issue of a potential joint venture between the restaurant and two party promoters that handled security, but in the end the trial court found no joint venture and no triable issues as to duty or breach, granting the motion in its entirety.
