The case involved a 2018 single-vehicle accident. The Plaintiff and her then-boyfriend purchased a used trailer from our client, an RV dealership, which also installed a trailer brake system on their vehicle. After driving roughly 120 miles, the couple lost control, and the vehicle and trailer overturned. Despite admitting the brakes functioned properly up to the moment of the accident, Plaintiff alleged faulty installation or testing of the brake system. Notably, Plaintiff failed to notify the dealership of the accident until filing suit two years later and did not preserve the vehicle or trailer for inspection. She also testified as to the actions taken by the driver, which according to our expert, likely caused the accident.
Plaintiff claimed over $100,000 in medical expenses and more than $500,000 in future care—much of it stemming from a fall months after the accident, which she attempted to link to an unsubstantiated head injury allegedly caused by the crash.
Before trial, Plaintiff served us with a $400,000 offer of judgment. On that same day, we served Plaintiff with a $75,000 offer of judgment. At trial, Plaintiff’s counsel asked the jury for an award of nearly $2.5 million. The jury deliberated for just 48 minutes before returning a unanimous defense verdict.
