KNCH’s Orange County Defense Team Secures Unanimous Defense Verdict for Public Entity Client

 

On October 24, 2024, Amanda B. Peterson, Esq. and Scott A. Martin, Esq. of the firm’s Irvine office obtained a 12-0 Special Verdict in favor of their public entity client and two of its employees. The case was filed in 2019 in the Orange County Superior Court, alleging arrest and detention-related claims for excessive force, and failure to provide medical care (42 USC section 1983 for alleged violations of the U.S. Constitution) and California’s state law equivalent (the Tom Bane Act).  Plaintiffs also presented claims for Battery, and Intentional Infliction of Emotional Distress. It was a long trial, 10 court days, but the verdict for the client was achieved.

 

Plaintiff’s counsel had earlier demanded $2.0 million in settlement.  This was later reduced to $300,000 just before trial.  Plaintiff also informed that he would seek Attorney’s Fees of $1.0 million for any victory, under both 42 USC 1988 and California Civil Code 52.1(h).  Despite these demands the case proceeded to the jury and the outcome was worth the effort.
