Phoenix Attorney Dan Campbell Obtains Defense Verdict for Automobile Insurance Client after 5 Day Jury Trial in Tucson, Arizona
Partner Dan Campbell recently obtained a defense verdict in favor of an Automobile Insurance Client involving a collision where both parties claimed to have the right of way. KNCH represented a local husband and wife, who had retired to Tucson.
The Plaintiff was seeking a million dollars claiming she suffered a traumatic brain injury and continued to experience significant pain nearly four years after the incident. Defense argued that Plaintiff was at fault for running a red light, and that there was no medical evidence of any traumatic brain injuries. The jury heard testimony from Tucson Police, Plaintiff’s friends and family, a well-known local concussion expert, and a well-respected neurologist, whose presentation on brain anatomy showed that Plaintiff’s claims were factually and physiologically impossible.
After deliberating for approximately three hours following a five-day trial, the jury returned a verdict in favor of KNCH’s clients and awarded no money to the Plaintiff, failing to beat an Offer of Judgment, which allowed the clients to recover their costs and fees for the case. This trial took place in the Superior Court of Pima County.
