Phoenix Attorneys, Bill Nebeker and Joe Pishghadamian, Obtain Defense Verdict in a Rear End Automobile Lawsuit after 9 Day Jury Trial in Clifton, Arizona
William Nebeker, Partner and Joe Pishghadamian, Associate, along with Paralegals, Janelle Nebeker and Jennifer Arrington, recently obtained a defense verdict in favor of a client involving a three-vehicle accident. The client was the third and last vehicle in the accident and rear ended the plaintiff’s vehicle that had come to a stop behind the first automobile after passing through a controlled intersection on a green light. The plaintiff’s vehicle was then pushed into the first automobile that had come to a sudden stop.
The Plaintiff was seeking almost four million dollars claiming he was suffering from a traumatic brain injury that resulted in debilitating migraines, back pain and leg pain that prevented him from working and carrying out his activities of daily living. Defense argued that Plaintiff’s injuries were connected to a prior accident where he was continuing treatment. Testifying for the defense was neurologist Dr. Paul Francis and Orthopedic surgeon Dr. Michael Domer.
The defense offered $235,000 prior to trial, but the plaintiff refused to drop his demand below $475,000.
After deliberating for approximately two hours following a nine-day trial, the jury returned a verdict in favor of Mr. Nebeker’s clients and awarded no money to the Plaintiff, failing to beat an Offer of Judgment, which allowed the clients to recover their costs, fees and $25,000 in sanctions for the case. This two-week trial took place in the Superior Court of Greenlee County.
