Partner Dan Campbell completed a 7-day jury trial in the Superior Court of Pima County and obtained a 9-1 defense verdict. KNCH represented a local husband and wife, who had recently retired after serving the Tucson community as a husband-and-wife medical team.
The Plaintiff was seeking a million dollars claiming she suffered significant injuries to her neck and back and continued to experience significant pain nearly four years after the incident, which was a minor rear-end fender bender that occurred in a fast-food parking lot. Defense argued that the Plaintiff’s injuries were caused by a prior unrelated incident and that the forces present in this case could not have caused Plaintiff’s injuries. The jury heard testimony from Tucson Police, local EMT, and a well-respected orthopedic surgeon, whose presentation on orthopedic anatomy showed that Plaintiff’s claims were factually and physiologically impossible.
The jury agreed and returned a defense verdict after less than two hours of deliberation. Because of Plaintiff’s overreach, the jury awarded her no money, and the clients will likely be able to recover their costs and fees for the case.
