In both matters, the Plaintiff brought a cause of action for negligence against a public entity for allegations related to sexual abuse occurring in the foster care system. The Defense submitted a motion for summary judgment on the grounds that the public entity employees had complied with all mandatory statutory duties and, therefore, were entitled to immunity for any alleged injuries. At oral arguments the Defense successfully argued that the law was clear that no liability could be attached to the public entity for the alleged abuse. The Court agreed with the Defense’s position and granted summary judgment on the Plaintiffs’ claims for negligence.
